BK Alert: Maryland Local Rule Change

Background:

Effective December 1, 2025, the District of Maryland updated its Local Bankruptcy Rules related to Proofs of Claim (POCs). LBR 3002-2 has been added to address joint debtors in a bankruptcy, and whether a creditor’s claim is against one or both.

 

Upcoming Changes and Recommendations:

LBR 3002-2 will now require POCs to indicate, for each joint debtor, whether the claim is being filed against one or both debtors. The rule is unclear as to the exact method for designating liability, stating only that creditors ‘must…clearly state whether the claim is against one or both debtors in the case.”

Though ambiguous, PLG will ensure compliance with this updated rule by placing one of the disclaimers below on our POCs near the caption, to make clear which debtor is obligated under the note/contract:
