Our Texas Practice

​Padgett's Texas practice is staffed through its centralized location in the Dallas metroplex area and includes operational, legal, and practice-specific teams. PLG entered the Texas market through organic growth in 2018 and today offers comprehensive default services throughout the state, including foreclosure, evictions, title, title curative, litigation, bankruptcy, and REO.  Additionally, the firm offers one of the nation's most robust national practices, which includes bankruptcy, foreclosure, commercial foreclosure, and replevin services across the country. The firm's VP of Legal Operations, Keena Stallworth, Esq., and AVP of Foreclosure Operations, Michael J. Burns, Esq., are both based out of the firm's Dallas office.

Padgett’s Texas practitioners are highly experienced in the state’s non-judicial foreclosure process, which allows lenders to foreclose without court involvement when all statutory requirements are properly met. Texas offers one of the fastest foreclosure timelines in the country, making compliance and precision critical. When foreclosures are contested, Padgett’s Texas team is fully equipped to handle litigation and effectively navigate the complexities of the local legal system, including jurisdictional differences and related bankruptcy matters.

While foreclosures in Texas are primarily non-judicial, there may be circumstances that dictate foreclosure through judicial means, such as in the Show Me case. Padgett’s team is also well-versed in handling judicial foreclosures in state or federal court to obtain marketable title from foreclosure and recoup on client assets via the judicial process in what may generally be a non-judicial state.
